almotamar.net - Specialised Criminal Court in Yemen decided Sunday acceptance of defence presented by lawyer of the 12 Iranian defendants on non- specialty of the Yemeni judiciary to consider the case as the accused were caught in international waters.

In the court sitting held Sunday under chairmanship of Judge Radwan al-Nimr for the prosecution of the 12 Iranian defendants, among them one Pakistani national caught in their possession 3560 kg of hashish, the court listened to defence presented by the defendants Abdulaziz al-Samawi. The defence lawyer said the case is not the specialization of the Yemeni judiciary to consider as the defendants were caught in the international waters, not the Yemeni regional waters.

The court decided acceptance of the defence and to deport immediately the defendants to their countries and to destroy the hashish quantity seized with them and confiscation of their boat.

German forces had captured the defendants on 29 February 2008 after their departure of the Pakistani port of Qawadir and then they handed them over to the Yemeni Coast Guard forces.

On the other hand the Specialised Criminal Appeals Section confirmed on Sunday the execution of Sami Mubarak al-Saeedi the murderer of Judge Mohammed Aboud al-Shuaib Head of Civilian Section at the Seyoun Court.

In the court session held on Sunday under chairmanship of Judge Mohammed al-Hakimi he read out findings and text of the verdict that stipulated the confirmation of the primary death sentence and confiscation of the caught evidence.

The Specialised First Instance Criminal Court decided the beginning of last December the execution of the defendant and confiscation of evidence. The prosecution attributed to the defendant his murder of Judge Mohammed al-Shiaib last November at his office after sneaking into it and shot dead the Judge in his head.
